1. Acceptance of Terms

By accessing or using NotNowCapsule ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

NotNowCapsule is a time-capsule messaging service that allows users ("Senders") to create encrypted messages intended for future delivery to designated recipients. The Service provides:

• Encrypted storage of time-locked messages
• Time-based and event-based unlock conditions
• Key-based access for message recipients
• Content editing capabilities for message owners

3. User Accounts

To create capsules, you must register for an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

4. Capsule Creation and Ownership

When you create a capsule:

• You retain ownership of the content you create
• You are responsible for securely storing and distributing unlock keys
• You are responsible for remembering your edit password
• You may edit, revoke, or export your capsules at any time before they are unlocked

5. Encryption and Security

We use industry-standard encryption (AES-256-GCM) to protect capsule contents. However:

• We cannot recover lost unlock keys or edit passwords
• We cannot decrypt capsule contents without the unlock key
• You are solely responsible for key and password management
• No encryption system is 100% secure; use at your own risk

6. Acceptable Use

You agree not to use the Service to:

• Store or transmit illegal content
• Harass, threaten, or harm others
• Infringe on intellectual property rights
• Distribute malware or malicious content
• Attempt to circumvent security measures
• Use the Service for any unlawful purpose

We reserve the right to terminate accounts that violate these terms.

7. Service Availability

We strive to maintain service availability but cannot guarantee uninterrupted access. Capsules may have unlock dates years in the future, and while we intend to operate the Service long-term:

• We may modify or discontinue features with notice
• We recommend exporting important capsule data periodically
• In the event of service discontinuation, we will provide data export options

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOTNOWCAPSULE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR EMOTIONAL DISTRESS ARISING FROM:

• Your use or inability to use the Service
• Lost or forgotten keys or passwords
• Unauthorized access to your account
• Any interruption or cessation of the Service

9. Indemnification

You agree to indemnify and hold harmless NotNowCapsule and its operators from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

10. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
